Legal Liability Issues in Community Corrections: Are We Responsible for Failures, and How Can We Protect Ourselves?

Probation, parole, and community corrections officers are charged with managing short-term risk and long-term behavioral reform of those that they are required to supervise. It is well-known that not all criminals can be reformed, but that some can. Managing risk while working to change criminal behaviors is a daunting task, when working with people who have a track record for breaking the law, are often violent, and in communities that lack the resources needed to accomplish the objectives of supervision. When a case “goes bad,” whose is to blame? Civil liability continues to be a concern of many who work in our profession. Judges, prosecutors, and paroling authorities enjoy various forms of immunity. Probation, parole, and community corrections officers do not. We shouldn’t be defined by anecdotal failures, and caution should be exercised regarding contact standards that convey to outsiders that produce recidivism reduction. This workshop will discuss legal liability issues facing probation, parole, and community corrections officers and how to protect ourselves from civil liability.

SESSION PRESENTERS

Dr. Mario Paparozzi
Professor Emeritus, University of North Carolina at Pembroke


Dr. Paparozzi worked at the New Jersey Department of Corrections. He held positions from parole officer trainee through supervisory/management titles including Deputy Interstate Compact Administrator, Assistant Commissioner of Community Programs, and Chairman of The New Jersey State Parole Board. After retiring from his practitioner career, Dr. Paparozzi accepted a faculty appointment at The College of New Jersey’s Department of Law and Justice. In 2003, Dr. Paparozzi accepted a position at the University of North Carolina at Pembroke. Dr. Paparozzi’s numerous publications are extensively cited by scholars and practitioners. Dr. Paparozzi has provided numerous keynote addresses, seminars, and professional training in 46 states, Singapore, the District of Columbia, The United Kingdom, Ireland, Canada, Bermuda, Poland, Germany, and The Council of Europe in Strasbourg, France. He is a past-president of the American Probation and Parole Association, was a member or the Manhattan Institute's council to reinvent probation. He founded the New Jersey Parole Officers’ Benevolent Association - PBA #326. Dr. Paparozzi has appeared on several television and radio shows in the United States and Canada, including A&E’s Investigative Reports, NBC’s Dateline, Al Jazeera America, and Geraldo Rivera.
